Terms of use.

These terms govern your use of Ether — the website, the five standalone tools, the Universe Engine, and generated photography. Using any part of it means you accept them. If you are accepting on behalf of a company, you confirm you may bind it.

We write these in plain language on purpose. Plain does not mean weaker: every sentence here is meant literally, and where something limits your rights we say so directly rather than burying it.

The five standalone tools need no account. An account exists so you can save universes and buy credits. You must be old enough to enter a contract where you live — sixteen at minimum, eighteen where local law requires it.

There is no password: you sign in with a link sent to your email, or with Google. That means whoever controls your inbox controls your account. Keep it secure, and tell us if you think someone else has it.

One account is one person or one company. Sharing credentials across a team is not what the plans are priced for; buy a seat per person.

Prices are shown excluding tax. Tax is calculated at checkout from your billing address and added to the amount you pay. Payment is processed by Stripe; we never see or store your card details.

Subscriptions renew automatically at the end of each period until you cancel. Cancel any time from your account — it takes effect at the end of the period you have already paid for, and nothing is charged after that.

We may change prices. An existing subscription keeps its price until you change plan or let it lapse, except where a plan explicitly says otherwise. Founding memberships keep their price for as long as the subscription stays continuously active.

A credit buys one final, full-resolution photograph. Previews cost nothing.

Monthly credits are part of a subscription and reset at each billing cycle; they are not money and cannot be cashed out or transferred. Credits bought as a top-up expire ninety days after purchase.

If a render fails on our side, the credit is returned automatically. If a render succeeds and you simply do not like the result, the credit is spent — that is what generation costs us either way.

You own what you make, on the terms set out in the licence. Nothing you generate becomes ours, and we do not claim rights over your brand.

We do not train models on your work. We do not sell your universes or your uploads to anyone.

Most of this is obvious, but it needs to be written down.

• Do not use Ether to generate material that is illegal where you are, sexual material involving minors, or content whose purpose is to harass or defame a real person.
• Do not attempt to generate a real person’s likeness for a use they have not agreed to.
• Do not resell access to the engine, or wrap it in your own product as if it were yours.
• Do not try to bypass credit limits, rate limits or payment, and do not automate the site in a way that degrades it for others.
• Do not upload material you have no right to use.

Raw frames come from a third-party image model, then pass through our own grading engine. We choose the model and may change it; the grading and the look stay ours.

Generated images can be wrong, strange, or accidentally similar to existing work. We do not warrant that any output is original, non-infringing or fit for a particular purpose. Before you put a generated image on something that matters, look at it properly — that is your job, not the model’s.

We run the provider’s safety filter and keep our own restrictions. A blocked prompt is not a bug.

Ether is a beta. Things will break, features will change, and occasionally something will be removed. We will not remove a paid feature without telling you, and if we do remove one you have paid for, you may cancel and we will refund the unused part of the period.

We do not promise uptime. If the service is unavailable for an extended stretch, write to us and we will make it right.

You may stop at any time: cancel the subscription, or delete the account by writing to [email protected]. Deleting the account removes your universes and your ledger; shared links stop working.

We may suspend or close an account that breaks these terms, that is used for fraud, or where a payment is repeatedly reversed. Where the breach is not serious we will ask you to fix it first.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Beyond that, our total liability to you for any claim is capped at what you paid us in the twelve months before it arose, or one hundred euros if you paid us nothing. We are not liable for lost profits, lost business, or the cost of substitute services.

We provide Ether as it is. Beyond the promises written on this page we make no warranties, express or implied.

We may update these terms. If a change materially affects you we will say so by email before it takes effect, and continuing to use Ether after that means accepting it. The date at the top always reflects the current version.

These terms are governed by the laws of the United Arab Emirates, and the courts of Sharjah have jurisdiction. If you are a consumer in the EU, EEA or UK, this does not take away the protections of your local law, and you may bring a claim where you live.

Refunds are covered separately on the refunds page — 14 days on a first payment, no questions.
